Can a company delegate the power to dismiss one of its employees to an employee of another subsidiary of the same group?
BackIn a decision of 20 October 2021, the Court of Cassation interfered in the “family life” of a large luxury group regarding the dismissal of an employee of one of its subsidiaries by a human resources director, who was an employee of another subsidiary. The social chamber seems to be putting the brakes on the delegation of powers between between subsidiary companies belonging to the same group.
